By accessing or using ADVINTIS ("the Service"), operated by ADVINTIS Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including administrators, agents, supervisors, and end users interacting through the platform.
2. Description of Service
ADVINTIS is an AI-powered customer experience (CX) platform that provides unified omnichannel communication, autonomous AI agents, real-time analytics, and marketing automation tools. The Service is provided on a subscription basis as a multi-tenant Software-as-a-Service (SaaS) platform.
3. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old or have legal authority to enter into these terms.
- One person or entity may not maintain more than one account.
- You are responsible for all activities that occur under your account.
4. Subscription & Billing
- Paid plans are billed monthly or annually as selected during purchase.
- All fees are non-refundable unless otherwise stated in writing.
- We reserve the right to change pricing with 30 days' notice.
- Failure to pay may result in suspension or termination of your account.
- Free tier usage is subject to the limits specified on our Pricing page.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal, harmful, or fraudulent purpose.
- Transmit spam, malware, or unsolicited communications through the platform.
- Attempt to gain unauthorized access to other users' accounts or data.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service in a manner that could damage, disable, or impair our infrastructure.
- Violate any applicable laws, regulations, or third-party rights.
6. Data Ownership & Privacy
- You retain ownership of all data you submit to the Service ("Your Data").
- We process Your Data solely to provide and improve the Service.
- Your Data is isolated per tenant and not shared between organizations.
- Our use of your data is governed by our Privacy Policy.
- You may export or delete Your Data at any time through the dashboard.
7. AI & Automated Services
- AI-generated responses are provided as-is and may not always be accurate.
- You are responsible for reviewing and configuring AI behavior for your use case.
- We continuously improve AI models but do not guarantee specific performance metrics.
- Human-in-the-loop controls are available and recommended for sensitive use cases.
8. Third-Party Integrations
The Service integrates with third-party platforms (Meta, Slack, Microsoft, Google, TikTok, Twilio, etc.). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.
9. Service Availability
- We target 99.9% uptime for standard plans and 99.99% for enterprise plans.
- Scheduled maintenance windows will be communicated in advance.
- We are not liable for downtime caused by third-party services or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law, ADVINTIS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
11. Termination
- You may cancel your account at any time through the dashboard settings.
- We may suspend or terminate accounts that violate these terms.
- Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.
- Sections relating to liability, indemnity, and governing law survive termination.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Delaware.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
